Allow me to introduce myself:

Mark de Krosse, nice to meet you! In 2019, I decided to pursue formal training as a mediator so that I could work as an MfN-registered mediator. This training, combined with over 25 years of experience as a mediator and entrepreneur/CEO in a large family business, provided a solid foundation for my work as a mediator.

In addition to the general mediation training, I have further specialized in divorce mediation, family mediation, and employment mediation. These additional qualifications, along with my years of experience, enable me to tackle a wide range of complex mediations.

Throughout my career, I have been involved in various small and large conflicts, particularly within business families. Sometimes I was a party involved, but most often I was called in to help find a solution. The sense of fulfillment when a conflict is resolved has always motivated me to continue. Therefore, transitioning to the profession of MfN-registered mediator was a logical next step for me.

How does it work?

1.

Mediation as a tool for solutions

The starting point of the mediation process is a personal introduction. Mark is happy to visit you at home, or a neutral location can be arranged, such as Mark’s office. The first meeting lays the foundation for a successful collaboration and trust. Trust is crucial, as emotional topics will undoubtedly come to the table. To conduct open and honest discussions, trust is essential.

Mark takes ample time to map out your situation. Are there children involved? Are there issues like a business, a house, and what about pensions? The mediator in Velserbroek is ready to fully support and guide you through this emotional and complex period.

2.

The process

The divorce process itself typically consists of three meetings lasting one and a half to two hours, under Mark’s guidance. During these meetings, various topics are addressed. You will delve into substantive issues surrounding debts and assets, aiming to reach a fair division. Mark facilitates these discussions and seeks solutions that work for both of you. In the case of children, a parenting plan is also needed. This plan lays down crucial agreements regarding residence, vacations, and alimony arrangements.

Mark creates a safe environment where all emotions are given space. It is vital that you feel completely comfortable discussing all aspects openly. He encourages open communication, ensuring no aspect remains unaddressed. Together with Mark, you can navigate the path toward a balanced agreement, where everyone feels heard and understood.

3.

The legal documents

After completing the substantive discussions, Mark takes the next step by drafting the settlement agreement. All newly made agreements, including the parenting plan, are carefully documented.

Once all parties have given their approval, the documents are handed over to the lawyer. This specialist checks the legal correctness of the prepared documents before they are submitted to the court.

The parenting plan

When addressing the financial aspects of a divorce, the mediator first examines the prenuptial agreements and cohabitation contracts. When necessary, advice is sought from a notary. Subsequently, all assets and debts are detailed and assessed.

Topics addressed include alimony, the division of the home, bank accounts, insurance policies, shares, loans, businesses, and the costs associated with the divorce. The distribution of pension rights is also discussed according to the applicable legislation on pension equalization, where alternative arrangements can be considered.

The mediator in Velserbroek ensures that all financial aspects are carefully managed, so both parties can move forward after the divorce with a clear overview. This thorough and structured approach prevents any surprises post-divorce and guarantees a fair solution for both parties.

With the help of an experienced mediator, the divorce process is smoother and less stressful.

Why divorce with a mediator?

Divorcing without assistance can be quite challenging; you already have so much on your mind, and many changes are likely coming your way. It is helpful to engage a mediator, as you can be sure that everything is well taken care of. Here are the main advantages summarized:

✓ A mediator is often cheaper than a lawyer.

✓ A mediation process typically takes only three to five meetings of two hours each, so it can be completed quickly. Going to court can take months.

✓ Mediation often results in a better relationship between the parties, while a lawsuit usually does not.

✓ The costs of mediation are shared by both parties (usually each half).

If you aim for fair and sustainable solutions and find it important that nothing is overlooked, consider hiring a mediator.
