Emergency Procedure

1 Purpose

The underlying contingency plan has been established to inform clients in case of an emergency:

a) immediately that a scheduled mediation cannot take place (first-line backup by a proxy), and

b) if this situation lasts longer than two weeks, to ensure that clients are well supported so that they can temporarily or permanently transition to a colleague registered MfN mediator (second-line backup).

2 Definition of a contingency

A sudden and unexpected event that results in the mediator being unable to communicate with [his/her] clients.

3 Implementation of the contingency plan

3.1 Access to the mediator’s agenda by the proxy

In the first two weeks after the occurrence of the contingency, the proxy is authorized to access the agenda, contact information, and files as stored in the office and computer of the mediator. This authority extends to retrieving contact details and scheduled appointments in order to inform clients that the scheduled mediations cannot take place. The proxy also informs clients that, if the situation lasts longer than two weeks, the second-line colleague mediator will contact them regarding the further progress of the mediations. The ongoing/open mediation files will be easily identifiable in the work computer, and all appointments can be found in the agenda. The mediator will ensure that the access code for the computer is known to the proxy, Rudy van der Linden, for this situation. 

3.2 Possible transfer of ongoing files

In the event that the contingency lasts longer than two weeks, second-line colleague mediator Rudy van der Linden (MfN number 15699) is authorized to access the agenda, contact information, and files as stored in the office and computer of the mediator. The access code will be known through the first-line backup. The colleague mediator will consult with clients about the progress of the mediation. The options that may be considered include:

  • Transfer of the mediation to the colleague mediator, whether or not for the duration of the contingency. A new mediation agreement will be concluded with the parties based on the previously agreed hourly rate.
  • Transfer of the mediation to another MfN registered mediator or mediator of the parties’ choice. The colleague mediator will ensure the written and financial completion of the mediation for the purpose of the transfer.
  • Postponement of the mediation until further notice. The colleague mediator will agree with the parties on when a new contact moment will occur to discuss whether and to what extent the contingency continues and if it hinders further progress of the mediation.

4 Confidentiality

The parties hereby declare to respect the confidentiality that applies to mediations according to Article 7 of the MfN Mediation Regulations and to commit in writing to confidentiality by signing this contingency plan.
